Welcome to InvestMode. This Terms of Service agreement ("Agreement") constitutes a legally binding contract between Skalehub Inc., a Utah corporation doing business as InvestMode ("we," "us," or "our") and you ("User," "Student," or "Customer") governing your use of our websites, free digital indicators, premium custom prompts, the Agentic Investor Academy, and our recurring membership portals (collectively, the "Services").

By accessing our website, downloading our source code scripts, or submitting payment for our digital assets, you explicitly agree to be bound by all terms, conditions, and disclaimers contained herein. If you do not agree to these terms, you are strictly prohibited from using our Services.

1. No Financial Advice Declaration & Liability Waiver

InvestMode is a specialized educational and software workflow platform owned and operated by Skalehub Inc. We do not provide personalized financial, legal, tax, or portfolio management advice.

• Educational Purpose Only: All content, AI prompt templates, market insights, community discussions, and custom technical indicators (including our proprietary version 6 Pine Scripts) are provided strictly for technical, illustrative, and educational purposes.
• No Fiduciary Duty: Neither Skalehub Inc. nor its authors operate as registered investment advisors, wealth managers, brokers, or dealers with the U.S. Securities and Exchange Commission (SEC), FINRA, or the Utah Division of Securities.
• Assumption of Investment Risk: Financial investing involves a substantial risk of catastrophic capital loss. You acknowledge that you assume 100% individual responsibility for your capital allocation choices, portfolio decisions, and execution strategies. Skalehub Inc. does not guarantee any specific financial or performance outcome.

2. Third-Party Execution Platform Waiver

Our educational frameworks teach you how to coordinate software workflows utilizing independent, third-party platforms, including but not limited to Anthropic (Claude AI), TradingView, Unusual Whales, and Robinhood.

• Technical Malfunctions: Skalehub Inc. maintains zero operational control over these platforms. We assume no legal or financial liability for order execution lag, system outages, browser configuration bugs, API disconnects, or algorithmic errors occurring on third-party networks.
• The "Human-in-the-Loop" Clause: You explicitly acknowledge that our Phase 1 workflow relies on a mandatory "Human-in-the-Loop" approval process. You are completely responsible for manually reviewing, verifying, and entering your final risk coordinates into your independent brokerage account (Robinhood).

3. October Pre-Launch Billing & Digital Delivery Terms

• The Pre-Launch Special: By purchasing the Agentic Investor Academy during our October pre-launch window for the promotional price of $197, you are securing a pre-order seat.
• Fulfillment Timeline: You will receive immediate access to our open-source version 6 indicator scripts and the public channels of our private community hub. The full 8-module digital curriculum, video walkthroughs, and core prompt databases will officially unlock inside your student dashboard on November 1st, 2026.
• Statement Identifier: All billing transactions are securely handled by Skalehub Inc. Your financial statement will display the billing identifier: SKALEHUB-INVESTMODE.

4. Refund Policy & Core Satisfaction Guarantee

We back our pre-launch offer with an ironclad, conditional safety window:

• The Window: You are entitled to a 100% full refund of your $197 investment if a formal request is submitted via our support channel before the second live weekly module begins in November.
• Abuse Prevention: Downloading our version 6 open-source indicators, copying our premium prompt scripts, or utilizing our 1-on-1 High-Ticket Trading Desk consultation services removes your eligibility for an unconditional refund, as digital goods cannot be physically returned.

5. Intellectual Property Rights & Fair Use Licenses

All custom software code scripts, text copy, graphic assets, prompt matrices, and curriculum structures hosted on our platforms are the exclusive intellectual property of Skalehub Inc.

• Limited Personal License: Upon purchasing, you are granted a non-exclusive, non-transferable, revocable license to use our scripts and prompts for your personal, private portfolio management.
• Commercial Prohibitions: You are strictly prohibited from reselling, white-labeling, repackaging, or publicly distributing our source code scripts or prompt templates under another brand name. Violating our intellectual property terms will result in immediate termination of your platform privileges without a refund, and Skalehub Inc. reserves the right to pursue statutory damages under federal trademark and copyright protections.

6. Indemnification & Jurisdictional Bounds

You agree to indemnify, defend, and hold harmless Skalehub Inc., its officers, directors, and instructors from and against any and all claims, financial losses, liabilities, or expenses (including attorney's fees) arising out of your utilization of our software tools or financial education modules.

This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Utah, without regard to its conflict of law principles. Any legal actions or disputes arising from this contract must be filed exclusively in the state or federal courts located in the State of Utah.
